5:3-45. Use of rides not prohibited; conditions 15. a. This act shall not be construed as to prevent the use of any carnival-amusement ride if the ride has a New Jersey serial number and is maintained in a safe condition and in conformance with the rules and regulations of the department, and the owner or operator of the ride provides to the department a manual prepared by a licensed professional engineer or other qualified person acceptable to the department which contains the following information: (1) A schedule of periodic inspections and maintenance required to be carried out by owners and operators as needed to ensure continued safety; (2) A schedule of nondestructive testing that is necessary to ensure the continuing safety and soundness of the ride; (3) Operation procedures and training requirements for ride operators and attendants, including training regarding safety-based limitations on who may ride; (4) For mobile rides, a detailed set of erection instructions including any necessary support requirements; and (5) Any other information as the commissioner may prescribe by regulation. b. No carnival amusement ride which has a New Jersey serial number shall be modified unless: (1) All of the requirements of subsection a. of this section are met; and (2) The modification is pursuant to a supplemental modification certification or the owner or operator of the ride obtains individual approval of the modification in accordance with the provisions of section 12 of P.L.1975, c.105 (C.5:3-42).
