3B:12-34 Determination into fitness of a testamentary guardian of the person of an incapacitated person. 3B:12-34. Determination into fitness of a testamentary guardian of the person of an incapacitated person. If a will appointing a testamentary guardian of the person of an incapacitated person has been or is to be probated in the Surrogate's Court of any county or the Superior Court, the Superior Court may, in an action brought upon notice to the ward and guardian named in the will, inquire into the present custody of the incapacitated person, and make any order touching the testamentary guardianship as may be for the best interest and welfare of the incapacitated person.
